Form 16/16C

- If the claims included both liquidated & unliquidated, Form 16C must be attached upon service of the Defendant.

 - NO default judgment be entered : outside the ambit of O.13 r1 to r5. Reference : O.13 r.6 and 13/6/1 of HKCP 2014

Statement of Claim

- (HC) The statement of claim (included Pleadings & amended Pleadings) can not be served during court Summer Vacation (O.18 r5) without leave from the Court.

- Under O.62 Schedule 2

- Defendant pays the amount claimed within time and in the manner required by the indorsement of the writ before Judgment entered

Costs : 6000 + 630 = 6630

- Under O.13, O.13A or O.19

Costs : 6500 + 630 = 7130

Additional Party : add $350 per each

(HC)

Under O.62 Schedule 2

- Defendant pays the amount claimed within time and in the manner required by the indorsement of the writ before Judgment entered

Costs : 9000 + 1045 = 10045

- Under O.13, O.13A or O.19

Costs : 10000 + 1045 = 11045

Additional Party : add $500 per each

- After Form 16 filed by the Defendant, Plaintiff must file Form 16B within 14 days, otherwise the claim is stayed.
